or review Marital Agreements, which are also called
Prenuptial or Postnuptial Agreements. These are
contracts between adults who are either contemplating
marriage or who are already married. They are also used
when parties wish to enter into contracts in the case of
the death of either party, as to what the other party
will receive upon the death of the other. Richard S.
Victor, PLLC recognizes that no one enters into a
marriage with the intention of the termination of their
marriage. However, under Michigan law, marital
agreements, if they meet very strict rules and
requirements may be valid to protect assets and finances
in the case of the unlikely termination of marriage,
whether by death, divorce, annulment or legal
separation.

These agreements, may, in fact, promote marital harmony
between two people, especially when parties have been
married before and may have children and or have
accumulated property prior to their marriage and wish to
protect and or provide for premarital interests.
Agreements entered into after marriage, called
Postnuptial Agreements are much harder to enforce and
require a more stringent set of requirements as set
forth under Michigan law. Richard S. Victor, PLLC have
